PRIVACY NOTICE

Welcome to Locatium Solutions FZ-LLC, (“LOCATIUM”, “us” or “we”), a global corporation. This privacy notice explains the information collected and stored in LOCATIUM and the applications, web services and other mechanisms associated with LOCATIUM (collectively, the “Service”). The privacy notice also explains how we use the information collected in the Service.

HOW YOU ACCEPT THIS NOTICE

By accessing the LOCATIUM website (the “Site”) or using the Service, including registration, or by providing personal information (“PI”) (such as an email address), you accept the terms and conditions of this Privacy Notice.

COOKIES

Consider cookies a way of making interactions with the Site easy and meaningful. When you visit the Site, our servers send a cookie to your computer. Standing alone, cookies do not identify you personally; they simply recognize your web browser. Unless you decide to identify yourself by opening an account or filling out a form, you will remain anonymous to us.

THE INFORMATION WE COLLECT THAT IS NOT PI

We collect information which is not PI in relation to the use of the Site or the Service, such as login and information related to your device (for example, the type of your browser, your IP address and the date and time of use). This information might be considered PI in your jurisdiction.

HOW WE USE INFORMATION THAT IS NOT PI

We may use the information collected to improve the visitor’s experience on the Site, to maintain the Service and to understand how our Service is being used. We analyze traffic on the site in several ways, including the use of a service called Google Analytics or Facebook Pixel. This information is then used to generate statistics and measure the activity to improve the usefulness of the Site and the Service.

Google Analytics is subject to Google’s privacy policy. By visiting the Site or using the Service, you accept the terms of the Google Privacy Policy that apply to Google Analytics. These terms can be found in “How Google uses data when you use our partners’ sites or apps”, which can be found at https://www.google.com/policies/privacy/partners/, or any other URL that Google may provide.

Facebook Pixel is subject to Facebook’s privacy policy. By visiting the Site or using the Service, you agree to the terms of the Facebook Privacy Policy that apply to Facebook Pixel. These terms can be found at “Privacy sites or apps” published at https://www.facebook.com/help/, or at any other URL that Facebook may provide.

We are not responsible for any changes made to Google’s Privacy Policy and/or Facebook’s privacy, or of advising you on such changes. We reserve the right to change analytical service providers at any time without prior notice.

WHAT WE COLLECT THAT IS PI

We could collect the following IP from those who decide to buy our paid plan: name, address, email, phone number, credit card information and organization information. We can also collect another PI if you provide us with it (for example, in an email).

HOW WE USE AND DISCLOSE PI

We use personal information to provide you with the Service, to enhance our visitors’ experience of the Service, to maintain the Service, to understand and analyze how the Service is being used, to communicate with you about using the Service andto protect the security of the Service. If you accept marketing communications, the Company may also use the information you provide us with to send you information related to LOCATIUM. We may disclose the PI as required by law or in response to a legal process, such as a court order, subpoena, summons or the like. We may share PI with our corporate affiliates and with business partners that provide services related to the Service. These business partners do not have the right to use this PI for any purpose other than those related to the Service (such as website hosting or technical support).

Information about our users, including PI, may be disclosed or transferred to entities now or in the future affiliated with LOCATIUM or as part of any merger, acquisition, change of control, debt financing, insolvency, bankruptcy or sale of our assets. Except for the examples provided above, we will not sell or transfer your PI to third parties.

DO NOT TRACK

Currently, several browsers offer a “do not track” or “DNT” option that is based on a technology known as the DNT header, which sends a signal to the websites visited by the user about the configuration of the user’s DNT preferences. We are currently not committed to responding to DNT signals from browsers with respect to the Site, in part, because no common industry standard for DNT has been adopted by industry groups, technology companies or regulators. However, we will make efforts to continue to monitor developments around browser technology and the implementation of a DNT standard.

HOW TO ACCESS OR CHANGE THE PI THAT YOU PROVIDED

Once you have registered with us, you can access your profile, review the information stored and verify that information.

CUSTOMER DATA

Customer data is all the information that includes text, images, location data, other PI, or any other file that you provide, or is provided on your behalf through the use of the service. We inform you that you are responsible for the provision of any PI. We will not collect customer data. LOCATIUM only processes the provision of the Service, and it will not be used for any other purpose.

CHILDREN

We do not target, market or knowingly collect PI of children under the age of thirteen.

DATA RETENTION

We retain your IP for 2 years, after which time it is destroyed.

DATA SECURITY

We use industry standard physical, administrative and technical safeguards to preserve the integrity and security of your PI. However, we cannot guarantee the security of the information. Depending on where you live, you may have the legal right to receive notice of a security breach in writing or by emailing to legal@locatium.ai.

EUROPEAN ECONOMIC AREA (EEA) DATA PROTECTION RIGHTS

A. What we collect that is considered personal data in the EEA
We collect the following “personal data”, as defined in Regulation (EU) 2016/679 of the European Parliament and Council (the “GDPR”), from those who choose to buy our paid plan and of those who use the free LOCATIUM version: name, email address, LOCATIUM username, LOCATIUM account password, LOCATIUM account type; LOCATIUM account creation date; IP address; date and time of the first visit; date and time of the last session; number of pageviews; referral source; and social media information (eg, Twitter or Disqus account), job role, company name, phone number, website, location, description, billing address and/or credit card information that you choose to provide us with. In addition to the personal data you provide when downloading a resource or signing up for a webinar or demo—name, email address, phone number, your job role, and company name— we collect the following personal data: IP address; date and time of first visit; date and time of last session; number of pageviews; and/or referral source. We may also collect other personal data if you contact us or otherwise give it to us (for example, in an email).

B. How we use and disclose your personal information
We use personal information to provide the user with the Service according to the Terms and Conditions, to improve the experience of the user, to operate and maintain the Service, to investigate and understand how the Service is used, to communicate with you about the usage of the Service, to monitor and protect the security and integrity of the Service, and to analyze our business. We may share personal information with our corporate affiliates and with business partners that provide services related to the Service (such as hosting or technical support). These business partners do not have the right to use this personal information for any other purpose than the one related to the Service. We may participate in automated decision-making to improve the visitor experience and analyze and grow our business. For example, we can adapt mailing lists to certain groups in the industry or display certain information based on a user’s geographical location.

C. Legal basis for processing your personal data
The legal basis for processing your personal data is the contract, consent and/or legitimate interests, in particular, to conduct business within LOCATIUM, in order to develop our business, market and sell our products and services, and maintain the accuracy of our databases. When you have consented to the processing of your personal data for one or more specific purposes, you have the right to withdraw said consent at any time.

D. Data subject rights
Data subjects protected by the GDPR have the right to make certain requests with respect to their personal data controlled by LOCATIUM, and to file a complaint with a supervisory authority.

Right of Access
Each data subject protected by the GDPR has the right to obtain confirmation from LOCATIUM on whether their personal data are being processed, as well as the information described in Article 15 of the GDPR, if this is the case. case. Right to rectification
Each data subject protected by the GDPR has the right to obtain from LOCATIUM without undue delay the rectification of inaccurate personal data, as well as the right to complete previously incomplete personal data. If you wish to exercise this right, contact us at legal@locatium.ai.

Right to Erasure (Right to be Forgotten)
Each data subject protected by the GDPR has the right to obtain from LOCATIUM the deletion of the personal data regarding him or her without undue delay when one of the reasons listed in Article 17 of the GDPR applies. If one of these conditions is met and you wish to exercise this right, please contact us at legal@locatium.ai, using the email address you used when sending us your personal information, specifying your full name and the condition you think you believe to have been met.

Right to Restriction of Processing
Each data subject protected by GDPR has the right to restrict the processing of their personal data when one of the reasons listed in Article 18 of the GDPR applies. If one of these conditions is met and you wish to exercise this right, you can contact us at legal@locatium.ai, using the email address you used when sending us your personal information, specifying your full name and the condition in which you believe has been fulfilled.

Right to Data Portability
Each data subject protected by the GDPR has the right to receive their personal data which was provided to LOCATIUM, in a structured, commonly used and machine-readable format, when both conditions listed in Article 20 of the GDPR (1) apply. In addition, said data subject has the right to have her or his personal data transferred directly from LOCATIUM to another controller, provided that such transfer is technically feasible and that doing so does not adversely affect the rights and freedoms of others. Right to Object
Each data subject protected by the GDPR has the right to object , on grounds relating to her or his particular situation, at any time, to processing of personal data concerning her or him which is based on the GDPR’s Article 6(1) point (e) or (f). Automated, Individual Decision-Making
Each data subject protected by the GDPR has the right not to be subject to a decision based solely on automated processing which produces legal effects concerning her or him or similarly significantly affects her or him, and when one of the grounds listed in the GDPR’s Article 22 (2) does not apply. If you believe that none of these conditions has been met and wish to exercise this right, please contact us at legal@locatium.ai, using the email address you used when submitting personal data to us and specifying your full name.

E. The period during which personal data will be stored
Please see “Data Retention” above.

F. Hosting
This service and/or your personal data may be hosted the United States, a country with an adequacy decision by the European Commission (Privacy shield). By providing us with your personal data, you may be: (i) allowing the transfer of your personal data to the United States, which may not have the same data protection laws as the country in which you reside; and (ii) allow the use of your personal data in accordance with this Privacy Notice. In some cases, we may transfer personal pursuant to the Model Clauses, a copy of which can be downloaded from the Commission’s website.

G. Privacy shield
In accordance with the Notice Principle of EU-U.S. Privacy Shield, LOCATIUM informs data subjects of the EU, Iceland, Liechtenstein and Norway that:

  • LOCATIUM collects personal data specified in section A, “What we collect that is personal data in the EEA”, above.
  • LOCATIUM is fully committed to subject to the Privacy Principles all personal data received from the EU in reliance on the Privacy Shield.
    The purposes for which LOCATIUM collects and uses personal data are to improve the visitor’s experience of the Service; to operate and maintain the Service; to investigate and understand how the Service is used; to monitor and protect the security and integrity of the Service; and to analyze our business. LOCATIUM may also collect, store, and use personal data about your computer and/or your visits to and use of its Site, including your IP address, geographical location, browser type, referral source, length of visit, and number of page views.

The type of third parties with which LOCATIUM shares personal data are corporate affiliates and business partners, with the limited and specific purpose of providing services related to the Service. These business partners do not have the right to use this personal data for any other purpose. We may disclose personal information about our users to entities now or in the future affiliated with LOCATIUM for the purpose of enhancing the visitor’s experience of the Service; operating and maintaining the Service; investigating and understanding how the service is being used; monitoring and protecting the security and integrity of the Service; and analyzing our business. We also disclose personal information about our users as part of any merger, acquisition, change of control, debt financing, insolvency, bankruptcy or sale of our assets in order to complete our contractual obligations. Except for the cases provided above, we will not sell or transfer your personal data to third parties. Any person in the EU has personal data transferred to the United States has the right to access their personal data.

The choices and the means LOCATIUM offers individuals for limiting the use and disclosure of their personal data are the following: writing to us at any of the physical or email addresses indicated above and requesting the limitation or disclosure of their personal data. The independent dispute resolution bodies that LOCATIUM designates to address the complaints of individuals with respect to our breach of EU-EE. UU Privacy Shield is the EU data protection authorities (DPAs); LOCATIUM voluntarily commits to cooperate with the EU DPAs. LOCATIUM is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC). In cases where their complaints have not been resolved by any of these resource management mechanisms, individuals in the EU have the right to invoke binding arbitration under the Privacy Shield Panel. LOCATIUM is required to disclose personal data in response to lawful requests by public authorities, including to meet national security, law enforcement, or other public interest requirements. LOCATIUM is liable in cases of onward transfers to third parties. This privacy policy does not cover any applications, software or web-based applications supported or created by LOCATIUM or its partners. In compliance with the Data Integrity and Purpose Limitation Principle of the EU-U.S. Privacy Shield, LOCATIUM will take reasonable steps to ensure that personal data is relevant to its intended use, accurate, complete, and current.

In accordance with the Choice Principle of the EU-EE. UU Privacy Shield, LOCATIUM offers data subjects of EU, Iceland, Liechtenstein and Norway and the opportunity to exclude their personal data from (i) being disclosed to a third party or (ii) being used for a material purpose other than the purpose(s) for which that were originally collected or subsequently authorized. In accordance with the Security Principle of the EU-U.S. Privacy Shield, LOCATIUM shall take reasonable and adequate security measures, taking into account the risks involved in the processing and the nature of the data. In accordance with the Access Principle of the EU-U.S. Privacy Shield, LOCATIUM recognizes that data subjects of the EU, Iceland, Liechtenstein and Norway have the right to obtain a confirmation of whether LOCATIUM is processing personal data related to them, have the data communicated within reasonable time, and to correct, amend or delete personal data where it is inaccurate or has been processed in violation of the Principles.

In accordance with the Recourse, Enforcement and Liability Principle of the EU-U.S. Privacy Shield, LOCATIUM has appropriate mechanisms to guarantee compliance with the Principles and provides recourse for EU data subjects whose personal data have been processed in a non-compliant manner, including effective remedies. LOCATIUM complies with the Recourse, Enforcement and Liability Principle through a self-assessment system that includes the internal procedures provided by employees. Compliance is reviewed periodically in an objective manner. In conformity with the Accountability for Onward Transfer Principle of the EU-U.S. Privacy Shield, LOCATIUM acknowledges that the onward transfer of the personal data of data subjects of the EU, Iceland, Liechtenstein, and Norway will only take place (i) for limited and specified purposes, (ii) on the basis of a contract or comparable arrangement within a corporate group and (iii) only if that contract provides the same level of protection as the one guaranteed by the Principles.

OTHER INTERNATIONAL VISITORS

This service may be hosted in the United States. If you are an international visitor, you should bear in mind that by providing your PI, you may be: (i) allowing the transfer of your PI to the UAE, which may not have the same data protection laws as the country in which you reside; and (ii) permitting the use of your PI in accordance with this Privacy Notice.
